03 Jul Family Law Q & A: If I’m not working will I receive spousal maintenance and for how long?
Spousal maintenance exists as a means by which to assist a non-income earning spouse, or primary caregiver to children, the ability to retrain to enable them to re-enter the workforce. Usually, the maintenance will continue until a property settlement can be achieved and/or until the receiving party is able to self-support again. Final maintenance orders are usually made for a defined period of time and only if there are insufficient assets to provide a greater share of the assets in lieu of maintenance.
