Gaps in age between siblings is often an impeding factor on being able to resolve a parenting matter, as a child(ren) may not be primarily attached to one parent, but one is. In the case of 3 (or more) children, whilst the elder 2 children may be candidates for an equal parenting regime, if of school age, the youngest, particularly if a gap of a few years in age exists, won’t be.

This makes settlement of the parenting matter and being able to reach a final outcome suitable for all 3 children, without splitting siblings, near impossible to achieve without a graduated arrangement.

For parents this is unfortunately a difficult pill to swallow, especially where they have researched their “rights” to a 50/50 parenting outcome – it must be in all children’s interests and wherever possible the Court will avoid splitting siblings.
