No fault divorce has been “a thing” since the introduction of the Family Law Act in 1975. This means, unlike in some other countries, there does not need to be a reason for the divorce or a need to “prove” anything by one party in order to be granted the divorce. In Australia all that is required to apply for and obtain a Divorce is for the relationship to have broken down irretrievably and for the couple to have been separated for a minimum period of 12 months.
